When GS TRACKME needed immigration assistance for key executives, the owners turned to Kirton McConkie. The company is transferring their executive team from its headquarters in Mexico, where there are over 3,000 employees, to South Jordan, Utah. To accomplish these transfers, the company needed to obtain the proper visa status for each member of their executive team, as well as qualifying family members. In a meeting in early 2013 with the company’s owner, Manuel Fragoso, the company’s short- and long-term business goals were revealed for each executive in the new U.S. office.
Our immigration section prepared and filed an E-2 investor visa application for Mr. Fragoso and dependent applications for his wife and qualifying children. The U.S. Consulate in Mexico approved the investor and dependent E-2 visa applications without incident. After Mr. Fragoso acquired E-2 investor visa status, we prepared and filed on his behalf an I-140 immigrant petition with U.S. Citizenship and Immigration Services (USCIS) requesting his green card classification as an international executive, which was approved. Mr. Fragoso and his family are waiting for USCIS to process their green card applications, which should be adjudicated by the end of the year.
Our immigration section also prepared and filed L-1A visa petitions for each executive, as well as dependent L-2 visa applications for their spouses and qualifying children. The L-1A petitions involved a new office in the U.S., which caused USCIS to issue extensive Requests for Evidence (RFE) after receiving the petitions. Working closely with the company’s executive team, our immigration attorney gathered and obtained the additional information that USCIS requested, and we incorporated and summarized the information into well organized and documented responses to the RFEs. USCIS approved all of the L-1A petitions for the executives, who have now arrived in the U.S. with their spouses and children.
