An application is filed with the court along with the deceased\u2019s will.\u00a0 In some instances, this can all be accomplished in a single day if all beneficiaries sign a Consent and Waiver.\u00a0<\/p>\n<p>&nbsp;<\/p>\n<p>Alternatively, formal probate may be necessary.\u00a0 This can be a simple process or it may lead to litigation, much like in trust litigation.\u00a0 In the simple case, a one-time hearing is held a few weeks after filing an initial petition. If there are no objections, the court will issue, at the time of the hearing, an Order and Letters appointing a personal representative for the estate.<\/p>\n<p>&nbsp;<\/p>\n<p>When someone dies without a will, it is called an intestate case.\u00a0 This requires a special petition be filed with the court to determine the heirs and to appoint a personal representative for the estate.\u00a0 This process requires formal probate and results in a probate hearing.\u00a0<\/p>\n<p>&nbsp;<\/p>\n<p>If an estate has no real property and is less than $100,000 in total value, a special \u201csmall estate\u201d procedure is available.\u00a0 A small estate can be transferred without the involvement of the probate court.
