Kirton & McConkie, a full service law firm approaching 100 attorneys, has represented clients with legal activities in more than 100 nations of the world and every state in the U.S. Many of our attorneys have lived outside the U.S. for at least two years, several of them as resident legal counsel for firm clients, and many are fluent in one or more foreign languages.  Several of our attorneys are natives of or are licensed to practice in foreign jurisdictions, including China, Japan and Mexico.  The firm’s International Law Practice Section works closely with Kirton & McConkie’s other practice sections, such as Immigration, Corporate and Tax, Intellectual Property, Business Litigation and others to provide a full array of services suited to each client’s needs, whether the clients are individuals, business entities or non-profit institutions.  In terms of the depth and breadth of our collective experience and capabilities, we believe we have the premier international tax practice in the Intermountain West, rivaling many of the more expensive coastal firms, while providing a more intimate and cost effective level of service.

Whether client needs are large or small, we are adept at providing high value services suited to their circumstances.  We work closely with associated attorneys in foreign countries or in the U.S., with in-house counsel, and with other client advisors to provide seamless professional services in a cost-effective manner.

Among other services, we advise domestic and international clients on how to go “global," including: (i) structuring multinational business operations; (ii) managing business and legal risks; (iii) facilitating business formations, including advising on choice of foreign entities and jurisdictions; (iv) achieving tax efficiencies at home or abroad; and (v) providing ongoing support for tax and legal compliance, risk management, transnational litigation, mergers and acquisitions and beyond.

 TECHNICAL EXPERIENCE

International clients feel comfortable with the attorneys in our International Law Practice Section because we understand their cultural backgrounds and home country legal systems.  During more than thirty years, we have advised and participated in the establishment or operation of legal entities in more than 100 countries.  We have supervised or directly participated in numerous transnational litigation matters, in addition to assisting with alternative forms of dispute resolution such as arbitration and mediation.  We have assisted multinational clients in achieving global tax efficiencies related to U.S. and foreign income taxes, VAT, customs duties, and related transaction costs.

From our collective experience working abroad, we bring home to our clients a wealth of knowledge regarding a host of foreign and international needs, including those regarding labor and employment matters, the development and termination of employment contracts, real property acquisitions and dispositions, construction contracts, international architects’ agreements, intellectual property protection and enforcement, immigration and visa matters, foreign probate, powers of attorney, debt collection and sophisticated tax planning.  We offer deep experience across multiple industries, including pharmaceuticals and health sciences, software and similar advanced technologies, manufacturing, construction, foreign franchising, and international philanthropy, among others.  More specifically, among our capabilities we include the following:
